
Marvel and DC are suing a Jerusalem store for selling kippa hats with licenesed heroes on them including Spidey. Kippa’s are caps that jewish men wear during times of prayer. According to this report the comic companies are suing for more than $25,000 in damages. What are your thoughts?

Well the guy must have known what he could get into if he was violating copyright laws. He took a bargain, and it didnt pay off. I say he deserves this.

Still, make some kind of deal with the guy, get a small back payment – $500, doubt he’s making conglomerate kind of money.
Then a modest royalty deal. THAT way, marvel and DC don’t come off looking quite so vicious, good PR.
I think it’s a shame when companies go after small businesses like this for damages instead of just sending a cease & desist. They don’t need the money, they’re just trying to “punish” the guy.
It wasn’t a smart move on his part, but suing him for 25,000 is needless. That’s undoubtedly a tremendous amount of money to him, but it’s almost nothing to these companies.
Maybe they could come to an agreement where they could offer Marvel and DC a Percentage.
Marvel is completely in their rights here. The above image is clearly based on a trademarked image, and if they were not making money off this, they could still probably still get away with “fair use”, however, because they are selling this, Marvel has a right to part of that pie.
First! I love this blog and have been a new follower for the past few months.
To be completely honest from the picture I see that there are more copy write characters on the kippas, not only Marvel.
Maybe it just so happens they sell the most of Marvel kippas, but I don’t think its fair to sue. Legally they don’t have a right to produce those kippas without the right cope write information. Marvel had to do what they have to do. There are probably millions of other companys and stores selling non copy writed products and I don’t see why they had to attck this one. Oh well.
